Photohawk Family: Terms of Use
Version: 1.0
Effective date: 20 October 2026
Published at: photohawk.com/personal/terms
These terms are an agreement between you and CLOUDCONCUR LTD (company no. 13399913), trading as Photohawk, 23 Caldey Gardens, Ingleby Barwick, Stockton-on-Tees, TS17 5HW, United Kingdom ("Photohawk", "we", "us") for the Photohawk Family app (in the app stores as "Photohawk: Family Photos") and the services that support it ("the app"). By using the app you agree to them. If you don't agree, don't use the app.
1. What the app does
The app scans the photos on your phone, on your phone, to find people, things and places (and, if you turn it on, to group faces into people), lets you search them, and lets you share photos with other people. Some features need a Photohawk account; some need a Personal or Family plan.
2. Your account
- You need a Photohawk account to share or receive photos. It is the same account used by other Photohawk apps.
- You must be at least 13 years old (16 where local law requires) to create an account.
- Give accurate details, keep your password safe, and tell us if you think your account has been used without permission. You are responsible for what happens in your account.
- You can delete your account at any time (see the Privacy Policy).
3. Plans: Personal and Family
- Personal is a monthly subscription to the app's features for you: finding and searching the people, pets, things and places in your photos, and the text in them, and sharing photos (one time, with groups, automatic sharing and trip mode). New subscribers can start with a 7-day free trial.
- Family is a monthly subscription with everything in Personal, for you and up to 5 other people. The subscriber invites them from the app (Settings > Family) with an invite link; each member uses their own Photohawk account, and their photos and face data stay their own. A member can leave at any time, and the subscriber can remove members.
- Receiving and viewing the photos people share with you, and joining groups you're invited to, are always free.
- The price of each plan is shown in the App Store or Google Play before you subscribe. There is no annual plan.
- Free trial: unless you cancel at least 24 hours before the trial ends, your subscription starts and you're charged when the trial ends. The App Store and Google Play offer a free trial once per store account.
- Subscriptions are sold and billed by Apple (App Store) or Google (Google Play) under their terms. Payment is taken when you subscribe (or when a free trial ends). The subscription renews each month until you cancel; cancel at any time, at least 24 hours before renewal, in your App Store or Google Play account settings. Refunds are handled by Apple or Google under their policies.
- If your plan ends (including a free trial that ends without a subscription): face grouping stops for new photos and videos, on your phone and in our cloud face-matching service; the people already grouped stay on your phone. Face data held in the cloud is deleted 30 days after the plan ends unless you subscribe again before then. Photos already sent stay with the people you sent them to, and receiving and joining groups stay free. Family members lose the plan's features when the subscriber's Family plan ends.
- We may change prices with notice as required by the stores and the law; a change applies from your next renewal.
Prints and photo products
- Where the app offers them, you can order prints, framed prints, canvases and photo books of your photos. They are made and delivered by our print partner, Prodigi, and paid for by card (including Apple Pay or Google Pay) through Stripe, not through the App Store or Google Play. The price, delivery cost and delivery estimate are shown before you pay.
- You can cancel an order free of charge until it goes to print. If an item arrives damaged, misprinted or doesn't arrive, tell us at support@photohawk.com within 30 days of delivery and we'll reprint it or refund you in full. This doesn't affect your legal rights as a consumer.
- Order only prints of photos you have the right to print.
4. Your photos and content
- Your photos remain yours. We claim no ownership of them.
- When you share photos, you give us a limited permission to store, encrypt, transmit and deliver them to the people you chose, only to provide the app. Shared photos are encrypted end to end, so we can't see them.
- You may share only photos you have the right to share. Respect the privacy of the people in your photos; don't share photos of someone with a person who shouldn't have them.
- Automatic sharing sends new photos of a person to the person you chose, without asking each time (unless you turn on "check before sending"). Check that you have chosen the right person and address. You can stop a share at any time.
5. Face grouping and cloud face matching
Face grouping is optional and off until you agree to the Face Data Policy. It groups the people in your photos and videos. With your separate agreement, cloud face matching (on by default once you agree, and you can choose "Keep it on my phone only") sends small face cut-outs, never your photos or videos, to our secure cloud face-matching service run for us by Amazon Web Services, to group people more accurately. Face data is kept and deleted as the Face Data Policy describes. Face grouping and cloud face matching are part of the Personal and Family plans, and are not available everywhere, including in Illinois. Grouping is automatic and can be wrong: check who is in a photo before you share it.
6. Receiving photos
Receiving photos is free. You can decline an invite, and stop receiving at any time. Photos you receive belong to the person who shared them (or whoever holds their rights); use them respectfully and in line with the law.
7. Acceptable use
Don't use the app to:
- share content that is illegal, sexual content involving minors, or content that harasses, threatens or invades someone's privacy;
- share photos of people who have asked you not to, or to track or identify strangers;
- send unwanted invites (spam) or invite people you don't know;
- break, overload, reverse engineer or get around the app's security or limits, except as the law allows; or
- break the law or anyone else's rights.
We may suspend or close accounts that break these terms, and report illegal content where the law requires. Report abuse to support@photohawk.com.
8. The app and changes to it
We license you to use the app on devices you own or control, for personal, non-commercial use. We may update, change or stop features. If we stop the service entirely we will give reasonable notice so you can keep your photos (which stay on your phone and in your recipients' libraries).
App Store users: these terms are between you and Photohawk, not Apple. Apple is not responsible for the app or its support, and Apple's standard Licensed Application End User License Agreement applies where these terms don't cover something.
9. Disclaimers
The app is provided "as is". Scanning, grouping and search are automatic and can miss or mislabel people and things. We don't promise the app will always be available or error-free, or that every photo will be found or delivered. Keep your own backups of your photos. Nothing in these terms limits rights you have as a consumer that can't be limited by law.
10. Limitation of liability
To the extent the law allows, Photohawk is not liable for indirect or consequential losses, or for loss of data, and our total liability for any claim about the app is limited to the greater of the amount you paid us in the 12 months before the claim and £50 (or the equivalent in your currency). Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or anything else that can't be excluded by law.
11. Ending this agreement
You can stop using the app and delete your account at any time. We may end or suspend your access if you break these terms, or if the law requires it.
12. Law and disputes
These terms are governed by the laws of England and Wales, and disputes go to the courts of England and Wales, except where the law of the country you live in gives you the right to bring a claim at home or to rely on its consumer protection laws.
13. Changes to these terms
We may update these terms. We'll tell you in the app before material changes take effect; if you keep using the app after that, the new terms apply.
Version history: 1.0, 20 October 2026: first published version (until then these terms were a draft).
